Golden Lotus Appeals Court Ruling
The attorney for Golden Lotus, Bill Schlecte, has filed a Motion for Relief from the July 25th ruling by Judge Murphy. This ruling clarified that the Interim Agreement signed by all parties calls for complete, not partial, dam removal (see item below). The Motion can be seen here, and our response here.
A hearing on the Motion for Relief is scheduled in Judge Murphy's court on Thursday, August 25th. We'll keep you updated as events occur.
Update: The motion by Golden Lotus was denied. Details can be found in our latest newsletter. Golden Lotus subsequently filed for leave to appeal the ruling with the Court of Appeals. The Court may grabt their leave, meaning it will hear their appeal, or deny it, meaning they won't consider it. In light of this, on November 9, Judge Murphy granted a motion by Golden Lotus to stay his order while they wait to hear if the Court of Appeals will consider their appeal of the order.

Court Ruling Upholds Dam Removal
Great news! Judge Murphy in the 46th Circuit Court in Otsego County ruled in favor of the motion made by the PRCA and Trout Unlimited that 'dam removal' as called for in the Interim Agreement signed by all parties, including Golden Lotus, Inc. and the MDEQ, means removal of all dam structures, not just partial removal. This is a victory for restoring a free flowing, natural river. Judge Murphy's ruling can be found here.
